By accessing and using SmartBIA ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
SmartBIA is an AI-powered business impact analysis platform that provides tools for financial impact analysis, cloud automation analysis, technology strategy decision support, business analysis, and tech loss prevention. The Platform includes features such as CMDB management, technology composition analysis, multi-cloud processing, risk matrix assessment, and cost-benefit analysis.
3. User Accounts and Registration
To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to: - Use the Platform in any way that violates any applicable federal, state, local, or international law or regulation - Transmit any malicious code, viruses, or harmful data - Attempt to gain unauthorized access to the Platform or related systems - Interfere with or disrupt the Platform or servers connected to the Platform - Use the Platform to analyze or process data in violation of any third-party rights or applicable laws
5. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. You are responsible for ensuring that any data you upload or process through the Platform complies with applicable data protection laws and that you have the necessary rights and permissions to use such data.
6. Intellectual Property
The Platform and its original content, features, and functionality are owned by SmartBIA and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit any of the content available on the Platform without our express written permission.
7. AI-Powered Analysis
The Platform utilizes artificial intelligence and machine learning technologies to provide analysis and insights. While we strive for accuracy, the AI-generated analysis, recommendations, and insights are provided "as is" and should be used as decision support tools rather than as definitive advice. You are responsible for validating and verifying any analysis or recommendations before making business decisions based on them.
8. Cloud Processing and Third-Party Services
The Platform may integrate with third-party cloud services (including but not limited to Azure, AWS, GCP, Digital Ocean, and Hostinger) for automated resource discovery and cost analysis. Your use of these third-party services is subject to their respective terms of service and privacy policies. SmartBIA is not responsible for the availability, accuracy, or reliability of third-party services.
9. Subscription and Payment
Certain features of the Platform may require a paid subscription. Subscription fees, payment terms, and billing cycles will be specified at the time of purchase. All fees are non-refundable except as required by law. We reserve the right to change our pricing with reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by law, SmartBIA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.
11. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. SmartBIA disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SmartBIA operates, without regard to its conflict of law provisions.
